MEDIATION - A way to work it out
WHAT IS MEDIATION?
Mediation is an alternative to going to court (where a judge makes the decision). It is a confidential structured process wherein the parties in conflict meet with a trained impartial mediator who facilitates safe communication, assists the parties to identify their needs and interests enabling them to negotiate and control their own outcome.
It is a confidential and (mostly) voluntary process that promotes the self-determination of participants.
HOW A MEDIATOR CAN HELP YOU
Be heard by each other in a safe way and exchange information
Identify and explore interests, issues and underlying needs
Develop options and reality test for sustainability
Negotiate and control a mutually accepted agreement
Nationally accredited mediators are bound by confidentiality, impartiality and not giving advice.
WAYS OF DEALING WITH CONFLICT
Compromising: each with a little but unsatisfactory win.
Competing: each trying to beat the other.
Court: expensive, stressful and decisions made by a third party – and can be public.
Avoiding: not engage in the hope the conflict will disappear.
Giving in: one just allows the other to win.
Collaborating: working together for a solution both can live with.
